Welcome to Cardly ("we", "us", or "our"), available at https://cardly.love. By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use Cardly.

1. The Cardly Service

Cardly is an AI-powered platform that allows users to:

• Generate custom greeting card images and written messages using artificial intelligence
• Purchase physical greeting cards that are produced and shipped via third-party print-on-demand (POD) partners

We reserve the right to modify, suspend, or discontinue any part of the service at any time.

2. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use Cardly. By using the service, you confirm that you meet this requirement.

3. User Inputs & Content

a) Your Inputs

You are responsible for the text, prompts, names, and information you provide ("User Inputs"). You agree not to submit content that:

• Is illegal, harmful, hateful, defamatory, or obscene
• Infringes intellectual property or privacy rights
• Violates any applicable laws or regulations

b) AI-Generated Content

Cardly uses AI to generate images and text based on your inputs. You acknowledge that:

• AI-generated content may not be unique or error-free
• Cardly does not guarantee accuracy, originality, or suitability for any specific purpose
• You are responsible for reviewing content before placing an order

4. Ownership & Usage Rights

• You retain ownership of your User Inputs
• Cardly grants you a personal, non-commercial license to use the AI-generated card content for its intended purpose
• Cardly retains all rights to the platform, AI systems, branding, and underlying technology

You may not resell, redistribute, or use Cardly-generated content for commercial purposes without written permission.

5. Orders, Payments & Fulfillment

• All prices are shown at checkout and may include taxes and shipping where applicable
• Payments are processed securely through third-party payment providers
• Physical cards are produced and shipped by third-party POD partners
• Once an order is placed, it cannot be modified or cancelled, as production begins shortly after purchase

6. Shipping & Delivery

• Delivery times are estimates and not guaranteed
• Cardly is not responsible for delays caused by shipping carriers, customs, or events beyond our control
• Incorrect or incomplete shipping information provided by you may result in failed delivery

7. Refunds & Returns

Due to the custom, made-to-order nature of our products:

• All sales are final
• We do not accept returns or offer refunds for change of mind

Refunds or replacements may be issued at our discretion if:

• The card arrives damaged
• There is a printing or fulfillment error

You must contact us within 7 days of delivery with photographic evidence.

8. Prohibited Use

You agree not to:

• Abuse, exploit, or reverse-engineer the service or AI systems
• Use Cardly to generate harmful, misleading, or illegal content
• Attempt to bypass pricing, payment, or security features
• Interfere with the operation of the website or servers

We may suspend or terminate access for violations without notice.

9. Disclaimer of Warranties

Cardly is provided "as is" and "as available."

We make no warranties, express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Accuracy or reliability of AI-generated content

Your use of the service is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, Cardly shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or goodwill
• Errors in AI-generated content
• Delays or failures caused by third-party providers

Our total liability shall not exceed the amount paid for the relevant order.

11. Indemnification

You agree to indemnify and hold harmless Cardly from any claims, damages, or expenses arising from:

• Your misuse of the service
• Your violation of these Terms
• Your submitted content

12. Termination

We may suspend or terminate your access at any time if:

• You violate these Terms
• Required by law
• We discontinue the service

Termination does not affect completed orders or legal obligations.

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the United Kingdom, without regard to conflict of law principles.

We may update these Terms from time to time. Continued use of Cardly after changes are posted constitutes acceptance of the revised Terms.
